Terms of Sale

Last updated: October 10, 2026

The terms governing paid subscriptions to Plume, sold by Matterz Studio to businesses only.

Scope

These terms of sale govern paid subscriptions to Plume between Matterz Studio (SASU, RCS Paris B 943108688, 6 rue d'Armaillé, 75017 Paris, France — hello@plumeos.app) and the customer.

Business customers

Plume is a service reserved for professionals. By subscribing, the customer declares that it is acting for the purposes of its commercial, industrial, craft, liberal or agricultural activity, or on behalf of a business or organisation it has authority to bind, and not as a consumer. When subscribing, it provides the company’s name and its SIREN number, intra-EU VAT number or, outside the European Union, registration number, and keeps them up to date. Matterz Studio may refuse or suspend a subscription taken out in breach of this condition. These terms of sale do not apply to contracts concluded with consumers.

Plans, pricing & payment

Plume is sold as recurring subscriptions (monthly or annual) at the prices shown on the pricing page, in euros or US dollars according to the currency shown when you subscribe, exclusive of applicable taxes (VAT added where due). The currency is set when you subscribe: as long as a subscription of the same payer is running, later subscriptions and additions are billed in that currency. Payment is taken in advance each period via Stripe, by card or another method offered at checkout. An addition during a period (a seat, a brand, the move to the Studio plan) is billed pro rata for the time left until the end of the period: on the next invoice for a monthly subscription, immediately for an annual subscription. The amount is shown to the customer before they confirm.

Any late payment automatically incurs penalties at the European Central Bank refinancing rate plus 10 percentage points, and a fixed recovery fee of €40.

Included usage and reasonable use

Each subscription includes, per calendar month, usage limits and an included artificial intelligence model usage capacity, set out on the pricing page and shown in percent in the service settings (“This month’s usage”). The usage capacity measures the processing the service performs on the customer’s behalf (writing, conversation, scoring, search, analysis). The share of capacity used by each processing depends in particular on the model used and on the complexity of the request. This scale may change with the cost of the models, under the conditions set out for changes to the limits. It is neither a credit nor a refundable amount, and any unused part does not carry over to the next month. On the Studio plan, the limits and the usage capacity are set per brand and pooled across all the brands on the account.

The customer is warned on reaching 80% of the usage capacity or of a limit.

When the usage capacity or a limit is reached, the features concerned are suspended until the first day of the next calendar month, at no cost. The customer may restore them earlier by adding a seat (a brand on the Studio plan) or, where offered, by purchasing a recharge, at the price shown on the pricing page (€29 excl. VAT, or $32 excl. tax, per seat, per brand on the Studio plan), which raises the limits and the usage capacity of the current month by 50%. The recharge is added to the next invoice on a monthly subscription, and billed immediately on an annual subscription, with at most two recharges a month. A recharge applies to the current calendar month and is not refundable. Processing that fails for a technical reason attributable to the service is not counted. No amount is charged without an action by the customer.

To protect the service, Matterz Studio may apply daily caps to automatic processing, with no effect on normal use. Manifestly abnormal use (unauthorised automation, resale, circumvention of limits) may lead to suspension of the account after notice.

Any reduction of the limits or of the usage capacity is notified to the customer by email at least 30 days before it takes effect. It applies only from the next due date of the subscription: the following month for a monthly subscription, the renewal for an annual subscription. By way of exception, if a supplier of Matterz Studio withdraws a model or raises its price significantly, the reduction may apply during an annual subscription with the same notice. The customer may then terminate at no cost before it takes effect and obtains a refund of the unused part of the paid period.

No right of withdrawal

As Plume is reserved for professionals, the right of withdrawal provided for by the French Consumer Code does not apply.

Renewal, cancellation & refunds

Subscriptions renew automatically for the same period unless cancelled beforehand from your billing settings. Cancellation takes effect at the end of the current paid period, and access continues until then. Except where required by law, amounts already paid for the current period are non-refundable. Deleting your organization or account cancels the subscription immediately and ends access to the service, with no refund for the current period.

Customer content

The customer warrants that it holds the necessary rights to the elements it provides (photos, logos, trademarks, texts) or that it is authorised to use them. When it presents products of third-party brands, it warrants that it actually sells them, that its visuals do not suggest a commercial link or a partnership that does not exist, and that it complies with the distribution agreements that bind it to those brands. It indemnifies Matterz Studio against any third-party claim based on those elements.

Artificial intelligence providers

Some features of Plume rely on artificial intelligence models supplied by third parties, which the customer accesses only through Plume. The customer shall not circumvent the filters and safeguards of these features, extract or resell access to the service, use it to develop a competing model, or generate content that is unlawful, infringing, misleading or that depicts a real person without their consent. It complies with the “Acceptable use” section of Plume’s terms of use and with the usage policies of these providers, which are listed there. In the event of a breach, Matterz Studio may suspend access to the features concerned after notice, or immediately in an emergency.

Generated visuals

The visuals produced by Plume’s Studio (the “Visuals”) are composed by Matterz Studio from the elements provided by the customer and from images generated by third-party artificial intelligence models. Matterz Studio assigns to the customer, as they are created, any intellectual property rights it may hold in the Visuals: rights of reproduction, representation and adaptation, on all media, worldwide and for the full term of those rights.

The customer acknowledges that: (i) a generated image may not be protected by copyright; (ii) identical or similar images may be generated for other users, and no exclusivity is guaranteed; (iii) Matterz Studio does not guarantee that a Visual does not resemble any existing work, trademark or person.

The customer reviews each Visual before publishing it and alone decides on its publication. Matterz Studio does not reuse the customer’s Visuals or photos for other customers and does not use them to train artificial intelligence models.

Regulated content

For alcoholic beverages, Plume applies default limits and the health warning, intended to help the customer comply with the law. For food and drinks covered by Article L2133-1 of the French Public Health Code, the customer adds the required health information itself. These limits do not constitute legal advice. The customer remains the advertiser, alone decides on the publication of its content and is responsible for its compliance, in particular with Articles L2133-1 and L3323-2 to L3323-6 of the French Public Health Code.

Customer indemnity

The customer indemnifies Matterz Studio against any claim, action or judgment by a third party based on the elements it provides, the instructions it gives, the use or publication of content produced with Plume, or a breach of these terms. It bears the resulting sums and reasonable defence costs. Matterz Studio informs the customer without delay of any such claim.

Liability & governing law

To the extent permitted by law, Matterz Studio's liability is limited to the amount paid for the service over the 12 months preceding the event giving rise to the claim. These terms are governed by French law. Where the customer is a merchant (commerçant), any dispute falls under the exclusive jurisdiction of the competent courts of Paris.
